Meruelo Media rhythmic CHR “Power 106” KPWR Los Angeles has been slapped with a copyright infringement suit for allegedly posting copyrighted photos of Kim Kardashian, Kanye West, Drake and other celebs on its social media accounts without permission.
Redondo Beach, CA-based Backgrid USA says it owns and operates “one of Hollywood’s largest celebrity-photography agencies” and has licensed photos to TMZ, Entertainment Tonight, People and other media clients.
Filed Oct. 3 in U.S. District Court in the Central District of California, the suit claims KPWR “reproduced, distributed, displayed, and created unauthorized derivative works” of Backgrid’s pics of Cardi B, Kim Kardashian, Kanye West, Saweetie, Drake, and Dr. Dre on the station’s social media accounts without first obtaining permission or a license to do so. All in, Backgrid says the station infringed on its copyrights to at least nine celebrity photos in violation of federal law.
The complaint alleges KPWR did so “while knowing or having reason to know” the infringement was without permission or license.
The suit argues that KPWR drove “significant traffic” to its socials and “increased its revenues, in large part due to the presence of the sought after and searched-for Celebrity Photographs that frame this dispute.”
Backgrid says it has “suffered substantial economic damage” and is seeking a trial by jury. It’s asking for a declaration that KPWR is infringing on its copyrights and an order that would prevent it from any further alleged infringement. It also seeks an accounting of all profits and benefits from using the celebrity photos. Backgrid is also seeking actual damages, statutory damages, attorneys’ fees and interest.
